GENERAL TERMS AND CONDITIONS

The following terms and conditions apply to the booking and execution of city tours Weimar (hereinafter referred to as "organizers") individually organized city tours for groups and are guided tours guided by a licensed city guide only.

These conditions are based on any contract for guided city tours. Contractual partner of the customer is:

1. Scope

These general terms and conditions apply to the business relations of Stadtführungen Weimar with their customers. The general terms and conditions of Stadtführungen Weimar shall apply even if Stadtführungen Weimar confirms a customer's booking with knowledge of the terms and conditions of the customer. Conflicting, deviating or supplementary terms and conditions of the customer are only accepted by Stadtführungen Weimar in that they expressly agree to their validity in writing.


2. Conclusion of contract

a) Concrete bookings of guided tours of city tours Weimar must be made in writing or by e-mail. The booking is to be understood as a binding declaration of intent of the customer.

b) A contract with the Stadtführungen Weimar is only concluded when Stadtführungen Weimar has confirmed the customer's booking in writing or by e-mail ("order confirmation").

c) All changes to a binding booking will also be recorded only in writing or by e-mail.


3. Scope of services

a) The contractual service results from the description of services as well as the additional services listed in the booking confirmation. Ancillary agreements that change the scope of the contractual services require an express written confirmation.

b) The organizer expressly reserves the right to declare a change to the information, if there are unavoidable reasons. The overall layout of the agreed city tour must not be impaired. The customer will be informed immediately by the organizer.

c) The guided tours are on foot, all attractions are usually explained from the outside. The city tours are accepted and confirmed with a number of people up to 25 participants. Upon request of the customer more than 25 people can take part in the city tour, if this does not affect the quality of the city tour. If this is not possible, the customer is entitled to consult another city guide.

d) All information as well as the illustrations of the city tours in brochures, on the internet, etc. are merely examples of possible services. This does not guarantee any specific content for the city tours. City tours Weimar only owes the scope of services expressly stated in the order confirmation.


4. Unused services

If the customer does not make use of individual services after commencement of the journey as a result of early return travel or for other reasons, he has no claim to reimbursement or reduction of the price.


5. Termination of the contract

If the management is made considerably more difficult, endangered or impaired as a result of unforeseeable force majeure upon conclusion of the contract, both the organizer and the customer may terminate the contract. If the contract is terminated, the organizer may demand adequate compensation for the services already provided or the services to be performed until completion of the tour.


6. Cancellation

a) The customer can withdraw from the contract. A free cancellation is possible for the customer until the 30th day (Mon-Fri except on public holidays and on 24.12 and +49 03643 2526955 Before the agreed contract performance. The resignation will take effect on the day he arrives at the organizer. The withdrawal must be declared in writing by the customer. The organizer expressly reserves the right to charge the customer for services already provided on behalf of the customer.

b) If the customer withdraws after the 30th day before the agreed contractual service, the following fees will apply:

from the 29th to the 7th day before departure 25% valid price
from the 6th to the 3rd day before departure 50% of the valid price
from the 3rd day before departure 90% of the valid price.

c) If an agreed tour is not used without a written or verbal cancellation by the customer at least three calendar days before the agreed date, the customer will be charged a cancellation fee in the full amount of the agreed fee.


7. Payment

a) For the contracts, the respectively valid prices of the company at the time of the conclusion of the contract shall apply, unless otherwise agreed in individual contracts.

b) Unless otherwise agreed in writing, the price will be paid to the tour guide directly and in cash, by EC card or credit card immediately before the tour, unless otherwise agreed. A receipt will be sent to you by e-mail.

c) For billing addresses outside of Germany the customer has to pay in advance. Payment is made in advance by credit card or PayPal.

d) If the debit of the credit card of the customer is unsuccessful (eg because the credit card details provided by the customer are incorrect or there is insufficient coverage) Stadtführungen Weimar is entitled to withdraw from the contract in addition to its right to refuse performance.

e) If payment in advance has been made by credit card and there is a difference in favor of the customer (eg in the case of illness of a tour guide), the difference will be refunded to the customer via the credit card. If, after performance of the services, payments are still pending on the part of the customer, the unpaid services will be charged to the customer and the credit card will be debited accordingly.

f) The city guide is obliged to observe a waiting period of 30 minutes from the beginning of the agreed time of the tour. In case of delayed arrival of the guests to be guided, it must be agreed between the guests and the guide whether - if the guide has to fulfill other obligations - the tour will be shortened or if the originally agreed duration can be realized.

g) If the tour is shortened, the agreed fee will be charged in full.

h) If the customer requests an extension of service by the tour guide during the provision of services, the tour guide has the right to demand a correspondingly higher fee. The same applies if the contractually agreed period of time is exceeded by more than 30 minutes at the request of the customer. In this case, a lump sum of 30 € (<30 minutes), or 50 € (<60 minutes).


8. Exclusion

The right of the customer to grant him claims under the contract to third parties is excluded. Similarly, the customer is not entitled to authorize a third party to assert its claims in its own name.

9. Obligation to cooperate
The customer is obliged to cooperate in the event of performance disruptions within the scope of the statutory provisions, to avoid any possible damage / disruption or to keep it low. In particular, the customer is obliged to notify the organizer of any possible complaints without delay. Claims for non-performance or improper performance of services must be asserted in writing to the organizer within one month of the contractual termination of the tour of the city. Claims of the customer expire after 6 months. The limitation begins with the day on which the tour of the city should end the contract.


10. Liability

a) The organizer is liable in the context of the due diligence of a proper businessman for the conscientious preparation and execution of the city tour according to the agreed contract.

b) The organizer is liable for damages in the context of statutory provisions in case of his own intentional or grossly negligent action.

11. Scope and jurisdiction
a) For all first, current and future transactions to be concluded / concluded with the organizer, the following conditions apply exclusively. The organizer does not recognize conditions of the customer deviating from these general terms and conditions. These will not become part of the contract even if the organizer does not expressly object to them.

b) By placing the order, the exclusive validity of these terms and conditions is recognized by the customer.

c) The place of fulfillment and jurisdiction is, as far as legally permissible, Weimar. However, the organizer is entitled to assert claims against the client at any other court responsible for this matter.

d) For the conclusion of contracts German law applies.


12. Final provisions
The invalidity of individual provisions of the contract does not result in the invalidity of the entire contract.
The purchaser of a service accepts these general terms and conditions with the order / booking confirmation to Stadtführungen Weimar.


13. Severability clause

Insofar as individual provisions of these Terms and Conditions are or become ineffective, the validity of the remaining provisions shall not be affected thereby.
